Terms of Service

1. Acceptance of Terms

By creating an account or using Benny's Toy Chest ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By using Benny's Toy Chest, you represent that you meet this requirement.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Listings & Sales

Sellers are responsible for the accuracy of their listings. Items must be accurately described, including condition, completeness, and any defects. Counterfeit, illegal, or prohibited items are strictly forbidden and will result in immediate account termination.

Benny's Toy Chest charges a platform fee of 3.99% on completed sales, deducted automatically via PayPal.

5. Payments & Escrow

All payments are processed through PayPal. Buyer funds are held in escrow until the buyer confirms delivery. Sellers agree to ship items within 3 business days of payment. Benny's Toy Chest is not responsible for PayPal service interruptions or policy changes.

6. Prohibited Items

The following are prohibited on the Platform: counterfeit or replica items sold as originals, stolen property, illegal items, adult content, weapons, and any item prohibited by applicable law.

7. Disputes

Disputes must be opened within 30 days of purchase. Benny's Toy Chest will mediate in good faith but final resolution authority rests with PayPal for payment disputes. Once a buyer confirms delivery, the transaction is considered final.

8. Intellectual Property

All content on the Platform, including design, logos, and code, is owned by Benny's Toy Chest. User-submitted content (photos, descriptions) remains owned by the user but grants Benny's Toy Chest a license to display it on the Platform.

9. Termination

Benny's Toy Chest reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm other users, at our sole discretion.

10. Limitation of Liability

Benny's Toy Chest is a marketplace platform and is not a party to transactions between buyers and sellers. We are not liable for item quality, shipping damage, or transaction disputes beyond our stated dispute mediation process.

11. Changes to Terms

We may update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
